The U. S. Supreme Court ruled Friday in favor of the National Football League. The lower court ruled that the plaintiffs’ cause of action for alleged infringement of the Food and Drug Administration’s regulations regarding the marketing of prescription drugs cannot be predicated on the fact that they were prescribed for the treatment of erectile dysfunction and that the drug, Viagra, was prescribed for the treatment of the disorder.
Plaintiffs argued that the Food and Drug Administration and the State of Ohio did not have the authority to ban the prescription drug, Viagra, from the market. The FDA and the State of Ohio, in turn, argued that the plaintiffs’ cause of action against the defendants must be predicated on their failure to comply with the provisions of the Federal Food, Drug, and Cosmetic Act.
The lower court ruled that the plaintiffs had not demonstrated that the FDA and the State of Ohio did not have the authority to allow the defendant to market the drug for the treatment of erectile dysfunction.
The lower court noted that the Federal Food, Drug, and Cosmetic Act is not the only means of regulating pharmaceuticals. Under the federal act, the FDA may only regulate prescription drugs for sale in a drugstore and not in retail outlets. The FDA does not have the authority to mandate, for example, that pharmaceuticals be marketed to the public in violation of the Federal Food, Drug, and Cosmetic Act.
The lower court also found that the plaintiffs did not have any evidence of an abuse of the FDA’s regulatory authority.
The lower court also noted that the plaintiffs did not offer any evidence of any adverse effect on the plaintiffs’ ability to exercise their rights.
“Plaintiffs’ allegations do not meet their burden of proof,” the lower court said.
“Plaintiffs’ allegations are insufficient to meet their burden of proof and they cannot receive a fair and adequate remedy.”
A hearing on the issue of the FDA’s regulatory authority is scheduled for Jan. 24.
